RULES OF PURCHASE AND SALE
Rules of the e-shop www.jelans.lt, which define the conclusion of the purchase agreement and the obligations of the parties.
1.1. These rules of purchase and sale (hereinafter referred to as the “Rules“) establish the mutual rights, obligations and liability of both the person purchasing the items in the e-shop www.jelans.com (hereinafter referred to as the “Buyer“), and UAB “Korbis“ (hereinafter referred to as the “Seller“), when the Buyer purchases the items in the e-shop. By purchasing items in the e-shop, the Buyer agrees to the application of these Terms
2.1. The purchase and sale agreement between the Buyer and the Seller shall be deemed concluded from the moment when the Buyer, having formed the shopping cart in the e-shop, provided his information: full name, surname, delivery address, e-mail, telephone number, and after selecting the payment method and familiarizing with these Terms and Conditions, clicks the “Order”, and this agreement shall remain in force until the full fulfillment of the obligations under this agreement. In cases where the Buyer does not agree to all or part of the Terms and Conditions, he must not place an order.
3.1. The Seller shall have the right to suspend the operation of the e-shop temporarily or for an indefinite period after giving notice to the Buyers and undertakes to send the ordered items for which the Buyer has already paid.
3.2. The Seller shall have the right to unilaterally change these Rules by posting the amended Rules on the website of the e-shop. The amendments shall take effect from the date of publication for all transactions concluded after their publication.
3.3. The Seller has other rights provided in the Rules and the legal acts of the European Union.
4.1. The Seller undertakes to make every effort to enable the Buyer to properly use the services provided by the e-shop. The Seller makes no warranties that the e-shop will operate uninterrupted or that the data will be transmitted without errors. The Seller shall not be liable for any loss of the Buyer due to malfunctions of the e-shop and / or data transmission errors.
4.2. The Seller undertakes to deliver the ordered items to the Buyer within 3-10 working days after payment of the items.
4.3. The Seller undertakes to comply with other requirements set out in these rules.
5.1. The Buyer shall have the right to purchase items in the e-shop in accordance with these Rules and the legal acts of the European Union.
5.2. The Buyer (consumer) shall have the right to withdraw from the agreement of purchase and sale of items concluded in the e-shop with the Seller by giving written notice to the Seller within 14 working days from the date of delivery of the items. The Buyer shall have the right to withdraw from the agreement of purchase and sale of items with the Seller only if the item is of good quality, has not been damaged and has not substantially changed its appearance.
5.4. The Buyer has other rights provided in the Rules and the legal acts of the European Union.
6.1. The Buyer must pay the price of the items and their delivery, as well as any other taxes (if any in the agreement), and accept the ordered items. The Buyer shall pay for the items in the banks specified on jelans.lt and elsewhere.
6.2. The Buyer must fill in the return or exchange deed in the e-shop in order to return or exchange the item. The deed of exchange or return must be duly completed and sent with the returned items.
6.3. The Buyer must comply with other requirements set forth in the Rules and the legal acts of the European Union.
7.1. The Buyer is responsible for the correctness of the data provided. The Buyer assumes responsibility for the consequences of incorrect or inaccurate information.
7.2. The parties shall be liable for the violation of the purchase and sale agreement concluded using the e-shop in accordance with the procedure established by the legal acts of the European Union.
7.3. In the event of damage, the guilty party shall reimburse the other party for the direct loss suffered through its fault.
8.1. By clicking on the “Order” button, the Buyer confirms that he and his representatives (the Buyer have the consent of his representatives) agree to provide their personal data to the Seller and do not object to the personal data provided by the Buyer and / or his representatives being processed by the Seller for the purposes of identifying the Buyer and / or his representatives for the purposes of identifying the Buyer, concluding agreements, executing (online trading) or direct marketing. The Seller indicates that the Buyer (if the Buyer is a natural person) and his representatives’ personal IDs will not be processed by the Seller for direct marketing purposes.
8.2. By clicking on the “Order” button, the Buyer confirms that he (if the Buyer is a natural person) and his representatives have been informed they are informed of their right to access their personal data processed by the Seller and how they are being processed, to demand the rectification, erasure of their personal data or to suspend processing of their personal data in breach of the law and to object to the processing of their personal data.
8.3. By clicking on the “Order” button, the Buyer confirms that he and his representatives have the right to refuse to provide their personal data, but understand that personal data is necessary and required to uniquely identify the Buyer and / or his representatives for the purposes of concluding agreements, executing (online trading) and will not be able to enter into and / or execute the agreement without providing personal data and / or consenting to their processing for the above purposes.
9.1. The Buyer and the Seller agree that all information provided on the Seller‘s e-shop web site (including, but not limited to, these Rules, information about the Seller, the items and services offered and their features, the procedure for the exercise of the Buyer’s right to withdraw from the agreement of purchase and sale, care services and guarantees (if any) of the item provided by the Seller) shall be deemed to have been provided to the Buyer in writing.
9.2. All disputes arising from or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved by negotiation. In the event of disagreement, the disagreement shall be resolved in accordance with the procedure established by the legal acts of the European Union.
9.3.
